April 2008 – Changes in regulations

October 9, 2007

Mac is gearing up for the new Corporate Manslaughter and Corporate Homicide Act 2007, which is due for implementation in April 2008.  This Act is requires organisations to have all the relevant systems in place to ensure the safety and well being of their drivers, employees and members of the public.  It will enable for those who fail to do so to be more easily prosecuted.

In relation to drivers, it is not simply a case of checking driving licences once a year but to ensure that the individual is competent to fulfil the task.  In other words, is trained for the job.

For more information on the act, go to

The Health & Safety Executive document ‘Driving at Work’ provides information on the responsibilities for employers under current legislation.  To read or download this publication follow this link;

Those drivers of vehicles equipped with blue lights and sirens are not exempt from current or impending legislation and employers need to be considering the changes that may affect them.

Some emergency response organisations benefit from ‘Statutory Exemptions’ to certain aspects of road traffic legislation.  Currently these organisations are those used for fire.
